Scent-Sations, Inc. specifically does not authorize the use of its proprietary computers, servers, routers and computer network (the "Scent-Sations, Inc. Network") to accept, transmit or distribute unsolicited bulk e-mail sent from the Internet to Scent-Sations, Inc. distributors (or to others). It is also a violation of Scent-Sations, Inc. policy, and the law, to send or cause to be sent to, or through, the Scent-Sations, Inc. Network email that makes use of or contains invalid or forged headers, invalid or non-existent domain names or other means of deceptive addressing. Scent-Sations, Inc. considers such email to be unlawful and a violation of our policy, and any attempt to send or cause such email to be sent to, or through, the Scent-Sations, Inc. Network is unauthorized. Moreover, any email relayed from a third party's mail servers without the permission of that third party, or any email that hides or obscures, or attempts to hide or obscure, the source of an email also constitutes an unauthorized use of the Scent-Sations, Inc. Network. Email sent or caused to be sent to the Scent-Sations, Inc. Network that violates your agreement with Scent-Sations, Inc. is also unauthorized. Nor does Scent-Sations, Inc. authorize the harvesting or collection of usernames or distributor IDs from the Scent-Sations, Inc. Web sites for the purpose of sending unsolicited email. Any such action also constitutes violation of Scent-Sations, Inc. policy.

Scent-Sations, Inc. reserves the right to take all legal and technical steps available to prevent unsolicited bulk email or other unauthorized email from entering, utilizing or remaining within the Scent-Sations, Inc. Network. Such action may include, without limitation, the use of filters or other network devices, immediate termination of Scent-Sations, Inc. distributorship, and prosecution of offenders through criminal or civil proceedings. Nothing in this policy shall be construed to grant any right to transmit or send email to, or through, the Scent-Sations, Inc. Network, and in no event shall any failure by Scent-Sations, Inc. to enforce this policy constitute a waiver of Scent-Sations, Inc.'s rights.

Unauthorized use of the Scent-Sations, Inc. Network in connection with the transmission of unsolicited bulk email, including the transmission of counterfeit email, may result in civil and criminal penalties against the sender, including those provided by the Computer Fraud and Abuse Act (18 U.S.C. § 1030 et seq.); and various state laws, including the Virginia Computer Crimes Act (Va. Code Ann. § 18.2-152.2 et seq.) (as amended.)

Distributor Specific Spamming Policies/Guidelines

Except as provided in this section, Scent-Sations, Inc. Distributors may not use or transmit unsolicited faxes, mass e-mail distribution, unsolicited e-mail, or otherwise engage in “spamming” relative to the operation of their Scent-Sations, Inc. businesses. The terms "unsolicited faxes" and “unsolicited e-mail” mean the transmission via telephone facsimile or electronic mail, respectively, of any material or information advertising or promoting Scent-Sations, Inc., its products, its compensation plan or any other aspect of the company which is transmitted to any person, except that these terms do not include a fax or e-mail:

(A) to any person with that person's prior express invitation or permission (opted in); or
(B) to any person with whom the Distributors has an established business or personal relationship.

The term "established business or personal relationship" means a prior or existing relationship formed by a voluntary two-way communication between a Distributor and a person, on the basis of:

(A) an inquiry, application, purchase or transaction by the person regarding products offered by such Distributor; or
(B) a personal or family relationship, which relationship has not been previously terminated by either party.

All e-mail and fax messages must advise the recipient that he or she may request to be removed from the sender's mailing list by sending a reply e-mail or fax to the sender. The sender shall comply with all such requests. We do not condone the harvesting or purchasing of illegally obtained leads or e-mail addresses. E-mail addresses used for promoting Scent-Sations, Inc., its products, its compensation plan or any other aspect of the company should be obtained by yourself legitimately.

Any Scent-Sations, Inc. distributors or employees found to be violating this policy are subject to termination.
